BuyNest Terms of Service

These Terms of Service govern your access to and use of BuyNest and any related services provided by BuyNest (“BuyNest,” “we,” “us,” or “our”).

By visiting our website, creating an account, placing an order, or otherwise using our services, you agree to these Terms. Please do not use our website or purchase from us if you do not agree to them.

1. About BuyNest

BuyNest is an online home and lifestyle retailer offering home décor, organization, kitchen, bathroom, laundry, and related products.

Some products are sourced, processed, packaged, or shipped directly by third-party suppliers, warehouses, sourcing agents, and fulfillment partners. These partners may include CJdropshipping, USAdrop, domestic US suppliers, international suppliers, and shipping carriers.

BuyNest remains your primary point of contact for questions about orders, returns, refunds, and customer support.

2. Eligibility

You must be at least the age of majority in your state or place of residence to make a purchase from our store.

By using the website, you confirm that:

• You have the legal capacity to enter into a binding agreement.
• The information you provide is complete and accurate.
• You will use the website only for lawful purposes.
• You will not use our products or services in violation of applicable law.

3. Products and Product Information

We make reasonable efforts to display product descriptions, photographs, colors, measurements, materials, specifications, and prices accurately.

However:

• Colors may appear differently depending on your screen and device.
• Measurements may have minor variations.
• Natural, handmade, textile, wood, ceramic, stone, and similar materials may contain normal differences in texture, tone, grain, shape, or finish.
• Packaging may differ depending on the supplier or fulfillment location.
• Product details may be updated when a supplier modifies an item.

Such minor variations are not necessarily defects.

Customers should review all product descriptions, dimensions, materials, care instructions, and compatibility information before purchasing.

4. Product Availability

Products are subject to availability.

Although an item may appear available when an order is placed, supplier inventory can change before fulfillment begins. If a product becomes unavailable, we may:

• Cancel the affected item
• Offer a replacement or alternative
• Provide store credit with your agreement
• Issue a refund to the original payment method

We will contact you when practical before making a material substitution.

We do not guarantee that any product will remain available for a particular period.

5. Orders and Acceptance

Submitting an order does not guarantee that it has been accepted.

An order is accepted when we confirm it, begin processing it, or submit it to a supplier for fulfillment.

We may refuse or cancel an order for reasons including:

• Product unavailability
• Pricing or description errors
• Suspected fraud or unauthorized payment
• An incomplete or invalid shipping address
• Violation of these Terms
• Supplier or shipping restrictions
• Orders placed for resale without authorization
• Technical or payment-processing errors

If payment has already been collected for a cancelled order, we will issue an appropriate refund.

6. Order Changes and Cancellations

We will try to assist, but changes and cancellations are not guaranteed once an order has:

• Entered processing
• Been submitted to a supplier
• Been packaged
• Received a tracking number
• Been shipped

After shipment, the order is handled according to our Return and Refund Policy.

7. Prices and Payment

All prices displayed for the United States market are generally shown in US dollars unless otherwise stated.

Prices may change without notice. A price change will not normally affect an order that has already been accepted.

You agree to provide current, complete, and accurate:

• Shipping information

Payment is processed through Shopify and authorized payment-service providers. BuyNest does not normally receive or store your complete payment-card number.

Taxes, shipping fees, duties, and other applicable charges will be displayed where required or added during checkout.

8. Pricing and Website Errors

We may correct errors relating to:

• Promotions
• Product descriptions
• Availability
• Shipping charges
• Discount calculations
• Website content

If an error affects an order, we may contact you for instructions or cancel and refund the affected item.

We are not obligated to sell a product at an obviously incorrect price caused by a technical, typographical, supplier, or data-feed error.

9. Discounts and Promotions

Discount codes and promotions:

• Must be used according to their stated conditions
• May have expiration dates
• May apply only to selected products
• May not be combined unless expressly permitted
• May be limited to one use per customer or household
• Have no cash value
• Cannot usually be applied after an order is placed

We may modify, suspend, or end a promotion where permitted by law.

10. Dropshipping and Third-Party Fulfillment

You acknowledge that BuyNest may not physically store, inspect, package, or ship every product sold through the website.

Orders may be fulfilled by third parties, including:

• CJdropshipping
• USAdrop
• US-based suppliers and warehouses
• International suppliers and warehouses
• Manufacturers
• Sourcing agents
• Shipping and logistics providers

These partners may receive the information necessary to fulfill your order, including your name, shipping address, telephone number, ordered products, and delivery instructions.

An order containing multiple products may:

• Be fulfilled by different suppliers
• Ship from different locations
• Receive multiple tracking numbers
• Arrive in separate packages
• Arrive on different dates

Separate delivery does not mean an item is missing if the remaining package is still in transit.

11. Shipping and Delivery

Processing and delivery estimates are not guaranteed delivery dates unless expressly stated otherwise.

Shipping times can vary based on:

• Supplier processing
• Inventory location
• Destination
• Carrier performance
• Weather
• Customs processing
• Holidays
• Address verification
• Events outside our reasonable control

Customers are responsible for providing a complete and accurate shipping address.

Where possible, contact us immediately if an address needs to be corrected. We cannot guarantee that an address can be changed after processing begins.

For US internet orders, sellers must have a reasonable basis for advertised shipping times. When a seller cannot ship within the promised period—or generally within 30 days when no time is stated—the FTC rule requires the seller to obtain consent to the delay or provide a refund for the unshipped merchandise.

Accordingly, if we cannot ship within the applicable time, we may contact you to:

• Request your agreement to a revised shipping date, or
• Cancel and refund the unshipped item

12. Tracking

Tracking information may take several days to update after a label is created.

A tracking status such as “label created,” “shipment information received,” or similar wording may mean the supplier has prepared the shipment but the carrier has not yet recorded its first scan.

Contact us if tracking has not updated for an unusually long period or if a package is marked delivered but cannot be located.

13. Incorrect, Damaged, or Defective Products

Inspect your order shortly after delivery.

• Damaged
• Defective
• Incomplete
• Different from the ordered item

Include your order number and clear photographs of:

• The product
• The damage or defect
• The packaging
• The shipping label

We may require additional evidence before approving a replacement or refund.

Do not discard the item or packaging until the claim has been reviewed.

14. Returns and Refunds

Returns, exchanges, cancellations, and refunds are governed by our separate Return and Refund Policy.

By placing an order, you agree to review and comply with that policy.

Unless otherwise stated, returned products must normally be unused, uninstalled, unwashed, and returned with their original packaging, accessories, manuals, and tags.

Nothing in these Terms limits any non-waivable consumer rights provided by applicable law.

15. Refused, Undeliverable, and Returned Packages

You are responsible for providing a valid and accessible delivery address.

If an order is returned because it was:

• Unclaimed
• Addressed incorrectly
• Undeliverable
• Missing apartment or unit information

we may deduct actual shipping or return-to-sender costs from any refund where permitted by law.

A replacement shipment may require payment of additional shipping costs.

16. Customer Accounts

You may be able to create a customer account.

You are responsible for:

• Protecting your login credentials
• Keeping your account information accurate
• Restricting unauthorized access to your device
• Notifying us of suspected unauthorized activity

We may suspend or terminate an account that is used fraudulently, unlawfully, or in violation of these Terms.

17. Reviews, Photographs, and User Content

You may be able to submit reviews, photographs, comments, testimonials, or other content.

You retain ownership of your content, but by submitting it to BuyNest, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, display, and distribute it for store, marketing, social media, and promotional purposes, subject to applicable law.

You confirm that submitted content:

• Belongs to you or is used with permission
• Does not violate another person’s intellectual-property or privacy rights
• Is not false, defamatory, threatening, obscene, or unlawful
• Does not contain malware, spam, or misleading promotional material

We may remove content that violates these Terms.

18. Intellectual Property

The website and its original content—including the BuyNest name, branding, layout, text, graphics, logos, and custom design elements—are owned by or licensed to BuyNest and are protected by applicable intellectual-property laws.

You may use the website only for personal, non-commercial shopping purposes.

You may not, without written permission:

• Copy or reproduce store content
• Use our branding to impersonate BuyNest
• Scrape product or customer information
• Resell website content
• Reverse engineer website functionality
• Use our content to create a misleading competing store

Supplier-provided product images and descriptions may remain the property of their respective owners.

We may restrict access or cancel orders connected with prohibited activity.

BuyNest is not responsible for unrelated content, policies, availability, or conduct on third-party websites.

21. Shopify

Our online store is hosted through Shopify.

Shopify provides the ecommerce platform that allows us to present products and process transactions, but purchases from BuyNest are transactions between the customer and BuyNest, not between the customer and Shopify.

Your use of certain Shopify-powered features may also be subject to Shopify’s applicable terms and privacy notices.

22. Website Availability

We aim to keep the website available and accurate, but we do not guarantee uninterrupted or error-free access.

The website may be temporarily unavailable due to:

• Maintenance
• Updates
• Technical failures
• Hosting interruptions
• Cybersecurity incidents
• Events beyond our reasonable control

We may modify or discontinue website features without notice where permitted by law.

23. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the website and services are provided on an “as available” basis.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability arising from fraud, willful misconduct, or mandatory consumer-protection rights.

25. Indemnification

To the extent permitted by law, you agree to indemnify and hold BuyNest harmless from claims, losses, or expenses resulting from:

These Terms, together with our Privacy Policy, Shipping Policy, and Return and Refund Policy, form the agreement between you and BuyNest concerning use of the website and purchases from the store.

32. Governing Law

These Terms are governed by the laws of the Islamic Republic of Pakistan. Subject to any mandatory consumer rights, the courts located in Islamabad Capital Territory, Pakistan will have jurisdiction over disputes arising from these Terms, without limiting any mandatory consumer rights that apply in the customer’s place of residence.

You should complete this section according to the country and region where your business is legally established—not merely the country you target for sales.
